Liability Waiver JetSet Pilates LLC strongly recommends that you consult your physician before starting any exercise program. 1.1I, the Member, hereby affirm that I am in good physical condition and do not suffer from any mental or physical disability which would prevent or limit my participation in training with an independent contractor (fitness instructor) at JetSet Pilates LLC Studio. (JSP or The Company) 1.2I confirm that I have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulty); diabetes, epilepsy or any allergy) which may affect my participation in any sessions at the Studio. . Members with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Member should consult his doctor. I understand that I am voluntarily participating in a program of strenuous physical activity on the reformer. 1.3 The Studio reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of Studio facilities 1.4I understand that I am required to follow the instructions of the instructor at all times. 1.5I understand that advice provided by our instructors at no time constitutes medical advice in substitute for advice provided by a medical professional 1.6The Company accepts no liability for loss or damage to property of Members or for injury to Members on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion. 1.7I am aware that there exists the possibility of certain conditions occurring during or following training, including but not limited to lightheadedness, fainting, abnormal blood pressure or heart rate. I expressly agree that I have been informed that the program involves possible risks. I also understand that fitness activities involve a risk of injury and even death, and that I am voluntarily participating in theses activities. 1.8I hereby agree to expressly assume and accept any and all risk of injury and death. I fully understand that I may injure myself as a result of my participation in training program at JSP and hereby release JSP from any liability now or in the future including but not limited to heart attacks, muscle strains, broken bones, shin splints, back injuries, or soreness, occurring during or after my participation in the JSP program 1.9In consideration of my participation in training with an independent contractor (fitness instructor) at JJSP, I, for myself, my heirs and assigns, hereby release JetSet Pilates, its employees, independent contractors, officers and owners from claims, demands, and any causes of action arising from my participation in any personal training program at JetSet Pilates I hereby assume all risks connected therewith and consent to participate with JSP. I agree to disclose any physical limitations, disabilities, ailments, or impairments which may affect my ability to participate with JSP.
FILMING/PHOTOS IN THE STUDIOS Use of Personal Information, Image, Likeness, and/or Voice: We may photograph, record on audio or video, or otherwise record JETSET classes or member use of the Studio. In exchange for your use of the Studio or your participation in any JETSET class (whether in studio, outdoors, online or otherwise), you understand, acknowledge, and agree that you may be photographed, recorded on audio or video, or otherwise recorded and hereby agree and consent for all purposes to the sale, reproduction, and/or use in any manner of any such photograph, audio, video, or other recording or depiction of your likeness and/or voice whatsoever by us, any JETSET studio, the Franchisor (defined herein), the Franchisor Parties (defined herein), and any nominee or designee of us or them, including without limitation any agency, client, periodical or other publication, in all forms of media, whether now or hereafter devised, throughout the world and in perpetuity, and in all manners, including without limitation advertising, trade, display, editorial, art, and exhibition. You further understand and agree that any such photograph, audio, video, or other recording or depiction of your likeness and/or voice may be modified, altered, cropped, and combined with other content such as images, video, audio, text, and graphics, and hereby waive any right that you may have to inspect or approve any finished image, video, or audio containing a depiction of your likeness or voice. You further agree that the Studio, any other JETSET studio, the Franchisor (defined herein), and/or the Franchisor Parties (defined herein), may use any information gathered in this form or through your use of the Studio or participation in any JETSET class, provided the information does not personally identify you or provide facts that could lead to your identification, for any purpose, including without limitation research, product and program improvements, and statistical purposes. You agree to hold harmless and indemnify the Studio, any other JETSET studio, the Franchisor (defined herein), and the Franchisor Parties (defined herein), from and against any and all liability, damage, loss, and/or claims of any kind or nature whatsoever, including, without limitation, any and all claims and demands relating to libel, invasion of privacy, and violation of publicity rights.
COVID-19 WAIVER JETSET
The undersigned acknowledges that novel coronavirus ("Covid-19") infections have been confirmed throughout the United States, including in Florida. In accordance with the most recent guidance and protocols issued by the World Health Organization(WHO), the Centers for Disease Control and Prevention (CDC), for slowing the transmission of COVID-19 the undersigned hereby agrees, represents, and warrants that neither the undersigned shall visit or utilized the facilities, services and classes of JETSET ( other than any exclusive online services and programs) within 14 days after (I) returning from highly impacted areas subject to a CDC Level 3 Travel Health Notice, (ii), exposure to any person returning from areas subject to the above, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19. The CDC Travel Health Network is continuously updating this list and the undersigned agrees that they are aware of this list and the countries listed.
The undersigned hereby agrees, represents and warrants that the undersigned will not attend class if symptoms of COVID-19 are currently present, or he or she has a suspected or diagnosed/confirmed case of COVID-19.
JETSET has taken certain steps to implement recommended guidance and protocols issued by the Public Health Agencies for slowing the transmission of COVID-19, including, without limitation, the access/use restrictions set forth above.
The undersigned acknowledges and agrees that JETSET may revise its procedures at any time based on updated recommended guidance and protocols issued by the Public Health Agencies and further agrees to comply with JETSET revised procedures prior to utilizing the facilities, services, and programs of JETSET. The undersigned further acknowledges and agrees that, due to the nature of the facilities, services and programs offered by JETSET, social distancing of 6 feet per person among clients and instructors is not always possible.
The undersigned fully understand and appreciates both known and potential dangers of utilizing the facilities, services, and programs of JETSET and acknowledges that use thereof by the undersigned may, despite, the JETSET reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, series illness, disability, and/or death.
IN FURTHER CONSIDERATION OF BEING PERMITED TO ENTER JETSET FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO, TAKING CLASSES, THE UNDERSIGNED HEREBY AGRESS TO THE FOLLOWING:
THE UNDERSIGNED, ON HIS OR HER BEHALF HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE JETSET, its directs, officers, employees, volunteers and agents from all liability to the undersigned and all personal representatives, assigns, heirs, and next of kin of the undersigned for any loss or damage, and any claim or demand on account of any property damage or any injury to, or an illness or the death of the undersigned( or any person who may contract COVID-19, directly or indirectly, from the undersigned) whether caused by the negligence, active or passive, of the JETSET or otherwise while the undersigned or about the premises or any facilities or equipment therein or participating in any program affiliated with JETSET.
The undersigned hereby agrees to indemnify and save and hold harmless JETSET, its directors, officers, employees, volunteers and agents, and each of them, from any loss, liability, damages or costs they may incur, whether caused by the negligence, active or passive, or otherwise while the undersigned, upon, or about the premises or any facilities or equipment.
The undersigned understands and agrees that JETSET is not required to provide insurance to cover the undersigned in the event they suffer illness, injury, death, property loss, theft or damage of any sort upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with JETSET.
I HAVE CAREFULLY READ AND VOLUNATRILY SIGN THIS ASUMPTION OF RISK, RELEASE AND WAIVER OF LIABITY, AND INDEMNITY AGREEMENT AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. I AM AWARE THAT BY AGREEING TO THIS AGREEMENT I AM GIVING UP VALUABLE LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES FROM JETSET INCLUDING, FOR THE AVOIDANCE OF DOUBT AND WITHOUT LIMITATION, EXPOSURE TO COVID-19 AT ANY JETSET FACILITY OR PGORGRAM AND ANY ILLNESS, INJURY OR DEATH RESULTING THEREFROM. I UNDERSTAND THAT THIS DOCUMENT IS A RPOMISE NOT TO SUE AND A RELEASE AND INDEMNIFICATION FOR AL CLAIMS.
I HAVE READ AND UNDERSRAND THE TERMS OF THIS ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT AND AGREE TO ITS TERMS.
